Dependent Probate Representation
If a Texas Will does not provide for an Independent Representation, then the executor may have to proceed in a Dependent Representation. Under a Dependent Representation, all of the steps of an Independent Representation must be taken. However, the court must be asked permission or informed every step of the way. No sale can occur without court permission, and no distribution or transfer can be made without court permission.
A Dependent Representation is therefore more expensive to the estate, because many courts, including all of the probate courts in Dallas County, require that an attorney make each application for court approval on the Executor's behalf.
