Probating a Will

If you are reading this page, you have probably recently suffered the loss of someone close to you. Please accept our sincere sympathy. We understand that this is a difficult time. When you are ready, we are available to assist you to navigate the probate process. What follows will give you a general idea of the probate timeline and of the basic responsibilities of the Will’s Executor.
The first step in the probate process is to determine whether a valid Will exists. If so, the next step is to determine whether the Will provides for an Independent Representation under Texas law. An Independent Representation allows the Executor to settle the estate at minimum cost and time.
► The Probate Process
If the only asset for which beneficiaries need to transfer title is the deceased person's residence, it may be possible to probate the Will in an abbreviated and far less complicated proceeding called "Probate of Will as a Muniment of Title."
► Probate as Muniment of Title
If the will does not properly provide for an Independent Representation, a Dependent Representation may be necessary.
►Dependent Representation
In the event that the will is invalid, or if no will can be found, an Heirship or Affidavit proceeding or other court action may be necessary to be able to gain access to and to distribute the deceased person's property.
