Texas Durable Power of Attorney
By signing a Durable Power of Attorney, a person (called the "principal") invests another individual (called the "agent") with the power to make financial and business decisions on his or her behalf. The agent can sign any document and access any information that the principal could or would have been able to do.
In Texas, a power of attorney can be designated to be effective as of the date it is signed; or it can be designated to come into effect only if the principal becomes incapacitated or disabled and cannot legally sign on his or her behalf.
Having a signed power of attorney can save your family the substantial time and money of pursuing a guardianship in the future, in the event of an accident or other event or illness that results in temporary or permanent incapacity. As many as half of all Texans will experience a period of either physical or mental disability before their death. Accordingly, we recommend that you determine who your most trusted loved ones are, and put this document in place before an event occurs that makes this simple and effective safeguard no longer possible to execute.
A Texas Durable Power of Attorney will be in effect until the principal's death. It is for business and financial matters only -- not for healthcare decisions.
