Texas Last Will and Testament
In addition to setting out your wishes in an accurate and legally enforceable form, a basic Texas Will should contain the important elements on this checklist:
- It should contain the statutory language creating an Independent Representation without bond for your executor. This language will save your beneficiaries substantial time and money and will result in the most efficient probate process.
- It should have the legally required number of witnesses; and each witness should provide a contact address.
- It should be self-proved.
- It should allow your executor discretion to sell property.
- It should be signed and sealed in accordance with the correct statutory procedure.
- It should make provision to hold gifts in trust for minor beneficiaries, including future generations in the event beneficiaries in the next generation are not living when the will is probated.
- It should be drafted on long-life acid-free paper.
